We combine custom-trained AI with experienced human marketers to plan, write and deliver content for our customers. - All content drafted by By8am is reviewed by an experienced marketer and signed off by you before it publishes. - You retain full ownership of the content delivered to you and full responsibility for its publication on your channels. - Content marketing outcomes (such as traffic, engagement, rankings or conversions) depend on many factors. Past performance does not guarantee future results. --- 4. User Responsibilities By using By8am, you agree to: - Use the Service for lawful purposes only. - Not misuse, reverse-engineer, or attempt unauthorized access to the platform. - Provide accurate and lawful information through the By8am Onboarding Process and during ongoing use. - Take full responsibility for any content you choose to publish on your channels using the Service. --- 5. Subscriptions & Payments - By8am is a subscription service offered on monthly, quarterly, or annual billing cycles. - Payment is processed securely via third-party providers (e.g., Stripe, PayPal). - You authorize us to charge your selected payment method for recurring subscription fees unless you cancel. --- 6. Cancellation & Refund Policy - You may cancel your subscription at any time. Your access to the Service will continue until the end of the current subscription period, after which your subscription will not renew. - All paid subscription fees are non-refundable once billed. - Refunds may be granted only in cases of duplicate payments or technical errors. --- 7. Intellectual Property - All software, branding, designs, custom AI configurations, and platform content provided by By8am are the property of Resource Mode Pty Ltd. - Content delivered to you through the Service (drafts you have approved and that have been signed off) is your property to use, publish, modify or repurpose. - You are granted a limited, non-transferable license to use the Service and the By8am platform for the duration of your subscription. - You may not copy, distribute, or resell access to the By8am platform or its underlying software without prior written consent. --- 8. No Guarantee of Results - By8am provides content production and editorial services; we cannot guarantee specific outcomes such as traffic volume, search rankings, engagement rates, conversions, or business results. - All marketing and publishing decisions are at your own risk, and we accept no liability for business outcomes resulting from content delivered through the Service. --- 9. Limitation of Liability To the fullest extent permitted by law: - We are not liable for any direct, indirect, incidental, or consequential losses arising from use of By8am. - We are not responsible for third-party services (e.g., social media platforms, analytics providers, payment processors, hosting providers). --- 10. Compliance & Responsible Use - You are responsible for ensuring that any content published using the Service complies with applicable laws and the terms of any platforms on which it is published — including but not limited to laws relating to advertising standards, copyright, trademark, defamation, data protection, and consumer protection. - You are responsible for ensuring that any claims, statements, or representations contained in content you approve and publish are accurate and lawful. --- 11.
